As highlighted on our Disability Benefits website, our practice includes representing individuals in cases against insurance companies to get disability benefits. The cases are brought under the ERISA, the Employee Retirement Income Security, known as “ERISA”, or under State law for breach of contract.
We have had four successes in the past four weeks in our representation of deserving disabled clients. The cases were about:
- Lost in Space. Sadly, the claimant in this case suffered a severe stroke in March 2011. She has never recovered. Incredibly the long term disability carrier lost her file and did not adjudicate her claim. Fortunately, as a result of our efforts, we were able to get benefits for her back to March 2011 to the present which represented more than $100,000 in recovered benefits.
- The Quick Win. In this particular case, the insurer initially denied benefits to a seriously disabled claimant suffering from multiple sclerosis because his employer did not pay the outstanding premiums. Fortunately, we were able to argue to the insurer that there was a thirty (30) day grace period, and the claimant received her benefits very quickly. We also obtained Social Security disability benefits for this client.
- The Forgotten Interview and Videotape. In this particular case, the long term disability carrier took videotapes of the claimant and also conducted a personal interview at his house. Incredibly, the insurer refused to send either the videotape or the interview to its expert reviewing the claimant's medical records. We were able to convince the insurer that they could not deny benefits without even showing the videotape or interview to its expert, and the insurer has agreed to reinstate benefits.
- The Proud Expert. In this case, the insurer decided to terminate benefits without properly consulting with the treating physician that performed major back surgery on the claimant. The insurer literally denied benefits without considering the subsequent surgery. We were able to get benefits restored by obtaining the proud expert's recent medical reports and proof that the claimant was disabled.
