    On June 25, 2012, The U.S. Supreme Court has decided to hear an important case that can have a huge impact on protecting the rights of employees to get wages owed to them when they may not even know they are owed wages.  Specifically, the Supreme Court will decide whether an employer who makes an "offer of judgment" to the named claimant for the full amount of the owed wages can prevent the case continuing on behalf of other workers who do not even know that they are owed wages. The case is called Genesis Healthcare Corp. v. Symczyk. The Court of Appeals for the Third Circuit ruled that an employer could not stop the lawsuit from progressing by try to "pick-off" the named claimant. See http://www.ca3.uscourts.gov/opinarch/103178p.pdf. Let's hope the Supreme Court reaches the same conclusion.
