Everything that is really great and inspiring is created by the individual who can labor in freedom – Albert Einstein

At the law firm of Lebau & Neuworth, LLC, we share this belief – and put it into practice every day on behalf of our clients. Whether you are an individual employee seeking advice or part of a group or class of individuals facing complex employment litigation, L&N offers expert advice and counsel in representing your rights.

    How We Do It

We do it with focus. Our firm focuses almost exclusively on representing individuals and employees in employment and employee benefit matters and disputes. We do it with experience, through a team of lawyers who bring decades of experience to every case. We do it with results, by successfully winning cases and vindicating our clients in state and federal courts throughout the country.

     Our Focus

No matter whether you are a top-level executive in the corner office or a front-line worker on the factory floor, your individual employee rights matter. When threatened, they deserve to be aggressively protected. That's where L&N can make all of the difference. Ours is a practice that champions the rights of individual employees –and never companies, unions, or insurance companies. But while we focus on the individual, our representation is anything but limited. In fact, L&N has a national reputation for representing clients in court, mediations, negotiations and arbitrations successfully. Our services include:

    Employment Advice & Counsel

Are you uncertain of your employment rights, experiencing problems on the job, facing discipline or not advancing as you should? L&N will help you assess your issue, apprise you of your legal rights and obligations, and suggest courses of action.

Executive Employment Contracts and Restrictive Covenants

We often negotiate employment contracts in all industries for our clients directly with their employers as well as "behind the scenes" with our individual clients. Our expertise in evaluating compensation agreements, non-compete provisions, and other restrictive covenants provides a critical advantage in time-sensitive negotiations. We offer insights that most lawyers cannot.

    Negotiating Separation Agreements/Packages

L&N frequently negotiates separation agreements for employees who have been terminated, asked to resign or are about to be terminated. Such matters are handled with sensitivity, at this often-stressful time.

    Leave Issues

We offer counsel on leave issues, including medical leaves and short-term and long-term disability benefits to employees on leave. Issues often can arise concerning the length, timing and entitlement to a leave of absence, as well as retaliatory actions against employees who have exercised a right to a leave. Leave questions can include:

    • Family medical leave
    • Disability leave benefits
    • Disability discrimination and accommodation issues

Discrimination & Harassment & Retaliation Claims

L&N has broad experience in handling employment discrimination and harassment claims, based on gender, race, age, national origin, color, disability, religion, sexual preference/orientation and physical appearance. Our representation includes protection for our clients who may face retaliatory suits in response to their original complaints of discrimination and harassment.

    Termination Issues

We represent employees who have been wrongfully terminated, and bring actions against those who wrongfully terminate them. As experienced trial lawyers, we do not hesitate to file suit when appropriate. At the same time, we advise clients that alternative dispute resolution and mediation are often appropriate alternatives to litigation.

    Defense Against Employers

We defend those clients vigorously who are sued an employer, over claims arising from issues such as purported breaches of confidentiality or non-compete agreements.

    Compensation & Wage-Hour Issues

Employees who are owed wages, overtime, commissions, bonuses, and other forms of compensation often turn to L&N for counsel. Our firm has represented thousands of employees in claims for overtime wages. We frequently are engaged in class action litigation against some of the largest employers. Our insights and extensive experience in successfully resolving overtime, commission and compensation cases makes L&N a leading firm in this practice area.

    Disability Benefits

We are renowned for representing individuals’ claims for disability benefits from private insurance policies, employer-sponsored plans and government agencies. In preparing such cases, our attorneys work closely with medical professionals and vocational rehabilitation specialists. We possess a depth of knowledge that allows us to prevail in litigation against insurance companies.

    Employee Benefit Plan (ERISA) Issues

Employee benefit plan litigation involving the Employee Retirement Income Security Act (ERISA) is a central part of L&N’s practice. (ERISA is the federal law that governs many employee benefit plans such as health insurance, pension and retirement, and disability insurance plans.) Our firm represents clients in ERISA-related claims at all stages, from the initial claim to the appeal and litigation.

    Whistle-blower representation

We successfully represent whistle-blowers in False Claims Act litigation and similar claims brought under varying federal and state statues. L & N is well equipped to protect our clients rights and interests, by aggressive litigation and technical expertise.

    Public Sector Employees

L&N represents public sector employees in a wide range of matters, including advancement, discipline and termination issues.

    Health Care Professionals & Academicians

L&N frequently represents health care professionals and academicians involved in sensitive and serious employment matters. We represent tenured and untenured faculty members, teachers, physicians, nurse practitioners, physician assistants, nurses, dentists, and others in employment and licensure/credentialing matters.
