In the past month, Lebau & Neuworth obtained two very favorable settlements for dozens of employees who were not paid overtime when working more than 40 hours per week and did not get paid for all hours worked (i.e, “off-the-clock” work).
In a case involving waitresses at a bar/lounge, our clients filed a lawsuit for wages under the Maryland Wage and Hour Law and Fair Labor Standards Act by keeping some of the waitresses' tips. In a case involving debt collectors and credit advisors, the employer altogether failed to pay any overtime and only paid the workers based on a commission structure. In addition to suing for overtime, we asserted a that the employer intentionally issued fraudulent W-2s by failing to report all of their earned wages, including bonus checks.
(An employee can recover a penalty of $5,000 per year per for each fraudulent W-2 and attorney fees.) The case settled for our clients on very favorable terms.
