After more than 12 months of intense litigation, Lebau & Neuworth won a six-figure settlement on behalf of a truck driver who hurt her back when dealing with a trailer issue and was not allowed to return to work.
Our client filed a disability discrimination claim with the U.S. Equal Employment Opportunity Commission and, after receiving a probable cause determination, filed a court case alleging a violation of the Americans with Disabilities Act. The employer unsuccessfully argued that our client was on too much pain medication to return to work and that she did not try “hard enough” to get the employer to accept her back on the job.
The case settled shortly after the deposition of our client’s former immediate supervisor.
