Lebau & Neuworth partner attorney Richard Neuworth made a presentation for the Maryland State Bar Association Labor and Employment Law Section on November 18, 2020, regarding the issues of Whistleblowing in The Post-Covid Environment. The presentation addressed two
specific issues which concerned fraud being committed based on recent federal programs offered to private businesses and health and safety issues concerning employees being required to come back to work.
With respect to fraud, Richard presented both sides of all federal and state remedies that are available to whistleblowers that work for private businesses that attempt to defraud either federal or state entities. Statutes that were examined included the federal and state false claims act, FIFREA, Dodd Frank, Sarbanes Oxley and rights of employees that work for private employers that receive federal contracts.
With respect to health and safety issues, the remedies that were discussed included OSHA, National Labor Relations Act, the rights of at-will employees to engage in protected activity without fear of reprisal.
