Leave of Absence

Lebau & Neuworth provides expert counsel on Leave of Absence issues, including medical leaves and short-term and long-term disability benefits to employees on leave. We assist employees at all levels with various leaves of absence from work to which they are entitled for various circumstances under Maryland and federal laws.

Our employment lawyers handle a wide variety of Leave of Absence violations, discrimination and retaliation cases, including issues concerning the length, timing and entitlement to a Leave of Absence. Many issues are involved in Leave of Absence cases, so it can be difficult for the employee to determine things such as what leave of absence he or she is permitted, how long the leave of absence should last and whether or not the leave of absence is paid or unpaid.

An employee who has exercised his or her right to a Leave of Absence is entitled to take an unpaid leave for reasons that include a serious medical condition, disability, pregnancy, child birth or taking care of a seriously ill spouse, child or parent. There are many factors that determine the type of leave to which an employee is entitled – but if an employee is denied a legitimate Leave of Absence or is terminated or retaliated against for taking his or her rightful leave, the employer could be liable for lost wages or penalties, as stipulated by law.

Lebau & Neuworth employment lawyers put the law on the side of each client who has been unjustly fired over a Leave of Absence issue to ensure he or she is reinstated or is provided adequate retribution by the employer.
